Joe Biden signed an executive order on his first day in office that interpreted sex as “gender identity” under Title IX, a move that protected transgender athletes from being discriminated against if they wanted to participate in a sport that aligned with their gender identity, not their sex assigned at birth.

The policy shift comes a day after the US president signed an executive order limiting transgender women from sports competition.

President Donald Trump will use an executive order Wednesday to bar transgender athletes under the federal Title IX law. That law bars sex discrimination at educational institutions that receive federal funds.
